New FCC Supply Chain Data Collection Annual Report Requirement


On February 4, 2022, the Federal Communications Commission (FCC) issued Public Notice DA 22-109 for the new annual supply chain report. All advanced communications service providers are required to submit this new annual report by May 5, 2022, and by March 31 in subsequent years. The FCC defines “advanced communications service” to include all dial-up, high-speed, and broadband telecommunications services that enable end users to transmit and receive high-quality voice, data, graphics, and video telecommunications services. quality with a minimum speed of 200 kbit/s.

This is a new filing requirement to collect updated information since changes were made to equipment or services listed in the original Covered List from 2018. The updated Covered List is available on the FCC’s Covered List website. Prior participation in the 2019 Supply Chain Information Collection does not constitute compliance with this new annual reporting requirement.

By May 5, 2022, each service provider must either certify that they have no covered communications equipment and services or provide a list of covered communications equipment and services that the company has purchased, leased, leased or otherwise obtained.

If a provider certifies that it has no covered communications equipment and services, the provider will not need to file subsequent annual returns, unless the provider purchases, leases, leases or obtains equipment or Covered Communication Services or if additional Equipment or Services are added to the Covered Equipment or Services. Listing which would mean that the supplier can no longer certify that they have no covered communications equipment or services to report.

If a supplier who has previously certified that it does not have covered communications equipment or services must file a new annual report, it must declare information on this equipment when it is obtained, then annually as described in the preceding paragraph. .
